Director Legal - Environmental Litigation & Regulatory is
responsible for managing and providing legal counseling and advice
to the organization on a wide range of environmental matters,
including regulatory compliance and environmental
litigation.PRINCIPAL RESPONSIBILITIES:--
- Manages a team of attorneys and paralegals providing legal
support to the organization on a wide range of environmental
matters.
- Provides legal and professional support to relevant
organizational functions, including Environmental Solutions,
Engineering & Environmental Compliance, Sustainability, and Post
Collections Operations Support, with respect to environmental and
regulatory requirements, compliance and disclosures,
investigations, remedial and Superfund projects, transaction
diligence, policies and procedures, training, and other matters,
including the transportation and disposal of hazardous waste.
- Exercises deep knowledge of federal, state, and local
environmental statutes and regulations, and advise on major
environmental statutes and regulations, including:
- The Solid Waste Disposal Act, including the Resource
Conservation and Recovery Act (RCRA) Subtitles C and D;
- The Comprehensive Environmental Response, Compensation and
Liability Act of 1980 (CERCLA);
- The Federal Water Pollution Control Act of 1972 (the Clean
Water Act);
- The Clean Air Act and EPA regulations that require municipal
solid waste landfills to install landfill gas monitoring systems
and corresponding state laws and regulation.
- Manages a diverse docket of litigation, including claims
involving CERCLA, property damage, negligence, nuisance, toxic
tort, trespass, indemnity, and insurance coverage.
- Provides legal and professional support to the organization's
Risk Management team on environmental/pollution claims
investigation and management, insurance policies, and other
matters.
- Drafts media and other public statements regarding the
organization's environmental matters.
- Drafts and otherwise contributes to reports to the
organization's Chief Legal Officer, senior management, and
auditors.
- Provides briefing to senior management regarding environmental
matters, as requested.
- Provides regular coaching and guidance to team, supports career
development, manages performance through timely feedback and
mid-year and annual review discussions, and provides opportunities
for growth.
- Prepares legal budgets and recommend reserves.
- Selects and manages outside counsel and internal legal
staff.
- Provides training to management and other personnel.
- Participates in mediation and other forms of alternative
dispute resolution, including direct interactions with
environmental regulatory agencies.
- Assists with development and maintenance of organizational
policies and procedures, Legal Department administration, and other
matters.
- Overnight travel outside of Arizona.
- Performs other job-related duties as assigned or
apparent.QUALIFICATIONS:
- Experience working in a large, multi-state corporate or legal
environment.
- Environmental litigation experience.
- Experience managing legal professionals.
- Knowledge of federal, state, and local statutes and regulations
applicable to publicly-traded organizations.
- A proven track record demonstrating the ability to
independently make decisions regarding complex legal and corporate
issues.
- Outstanding written and oral communications skills.
- Outstanding organizational and time management skills.
- Strong collaboration skills.
- Excellent judgment.
- High integrity.
- Overnight travel may be required.MINIMUM QUALIFICATIONS:--
- JD; licensed to practice law and in good standing.
- Minimum of 10 years of experience performing the types of legal
work listed above, including significant experience with counseling
clients regarding the generation, transportation, or disposal of
